MEET OUR TEAM OF SOLICITORS

Picture
CIAN O’CARROLL
B.SC., DIP L.S., SOLICITOR
Cian completed a science degree before turning to law, qualifying as a solicitor in 1996
Read More
From the beginning of his training and career in law he has practiced exclusively in the area of litigation. In the early years he practiced in criminal defence, employment law and personal injury litigation but quickly developed a special interest in working on behalf of clients who had suffered an injustice at the hands of the State or its various organs.

His advocacy on behalf of the family of the late Brian Rossiter, a 14 year old boy who died in 2002 of head injuries while in the unlawful custody of the State at Clonmel Garda Station led to a series of legal actions and a statutory inquiry culminating in an apology to his family, substantial damages and disciplinary findings against some members of An Garda Síochána. The complex legal process also resulted in important changes to the regulations governing the custody of young persons in garda stations. The experience was formative for the remainder of Cian's practice.

Cian is best known for his work in the area of medical negligence in which his law firm specialises.

For the past 10 years or so the practice has been a lead provider of expert advice and advocacy for those affected by cancer misdiagnosis having worked on many breast, ovarian and of course cervical cancer cases. Fortunate to have worked for many courageous women who have turned their unenviable circumstances into an opportunity to improve medical care, the firm has played a supporting role in helping those campaigners to effect real and important improvements in our flawed healthcare system. Women like Olive Fahey, Emma Mhic Mhathúna, Vicky Phelan and Ruth Morrissey have influenced Cian through working with them in just the same way as they have positively influenced the delivery of healthcare in Ireland.

In 2019 Cian was awarded the Special Merit Award at the Irish Law Awards in recognition for the team's work fighting for justice for those women and families harmed through negligence in the delivery of the CervicalCheck screening programme.

Alice Moore graduated with a Batchelor of Laws degree (LLB) from NUI Galway before qualifying as a solicitor in 2017. She also holds a Diploma in Healthcare Law awarded by the Law Society of Ireland.

Practising exclusively in medical negligence actions in the High Court, Alice has a particular interest in the areas of delayed diagnosis of cancer, surgical error, gynaecological injuries and birth related injuries affecting both mothers and babies. She also has experience in fatal injury claims where cases are taken, for example, by a family member on behalf of a deceased loved one where medical negligence has caused death or by the parents of a child who has very sadly suffered a fatal injury during birth.

Since joining the practice in 2018, Alice has successfully concluded a number of high value medical negligence actions. Among these were actions under ‘case management’ and related to the delayed diagnosis of cancer. These cases, which were greatly expedited due to our clients having a very limited life expectancy, were taken from initial instructions to successful completion within a few months.

Alice is experienced in the complex litigation surrounding the CervicalCheck cancer misdiagnosis scandal and in October 2020, she led the successful team that represented Patricia & Damien Carrick in their groundbreaking case against the HSE for a fatal misdiagnosis of cancer within the CervicalCheck programme - the first time that the HSE admitted liability in court for their negligent management of CervicalCheck.
